Sood Khor Ki Virasat: Kya Waris Ko Hissa Lena Jaiz Hai?

بِسْمِ اللّٰہِ الرَّحْمٰنِ الرَّحِیْمِ

Islam ek mukammal zabita-e-hayat hai jo har mamle me hidayat deta hai — chaahe maal ho, tijarat ho, ya virasat. Aaj hum ek aise nazuk aur aham mas’ale par baat kar rahe hain jo aaj ke daur me aam hota ja raha hai: kya sud (سود) khor ki virasat me se waris ka hissa lena jaiz hai?


1. Sud ka hukum Qur'an ki roshni me

Allah Ta’ala ne sud ko sirf mana nahi kiya, balki us par apna aur Rasool (صلى الله عليه وسلم) ka jang ka elan farmaya:

فَإِن لَّمْ تَفْعَلُوا فَأْذَنُوا بِحَرْبٍۢ مِّنَ ٱللَّهِ وَرَسُولِهِۦ
(Surah Al-Baqarah, 2:279)
Tarjuma (Kanzul Iman):
“Phir agar tum aisa na karoge to Allah aur uske Rasool se jung ke liye tayar ho jao...”

Yani sud lena sirf gunah nahi, balke aise jurm ka darja rakhta hai ke banda Allah aur uske Rasool ke khilaf jung kar raha hota hai.


2. Hadees ki roshni me: Sood se talluq rakhne walon par lanat

Sahih Muslim, Hadith 1598:

نَهَى رَسُولُ اللّٰہِ عَنِ الرِّبَا وَأَكَلِ الرِّبَا، وَكَاتِبِهِ، وَشَاهِدَيْهِ، وَقَالَ هُمْ فِي الْإِثْمِ سَوَاءٌ

Tarjuma:
Rasoolullah (صلى الله عليه وسلم) ne sud lene wale, dene wale, uska likhne wale aur us par gawahi dene walon par lanat ki, aur farmaya: “Ye sab gunaah me barabar hain.”


3. Fuqaha ka raay: Sud se hasil maal ki virasat

Imam Abu Hanifa (رحمه الله) ke mutabiq agar kisi marhoom ki daulat me sud ka maal shamil hai:

  • Aur halal maal alag se pehchana ja sakta ho, to sirf halal maal lena jaiz hai.
  • Agar sud ka maal pura ya ghalib hai, to aise maal me waris ka hissa lena haram hai.
  • Agar lena zaroori ho to us maal ko faqeeron me baant diya jaye bina sawab ki niyyat ke.

4. Ala Hazrat Imam Ahmed Raza Khan (رحمه الله) ka fatwa

Fatawa Razawiyyah, Jild 19 me hazrat farmate hain:

“Jo maal sud se haasil hua ho, wo khud bhi najis hai aur uski warasat lena bhi haram hai. Agar kisi ko aise maal ka waris banaya jaye, to usay chhod dena wajib hai.”

Ala Hazrat ka yeh fatwa zamana-e-aakhir me hame is haram maal se bachne ka raasta dikhata hai.


5. Aaj ke daur me amal ka tareeqa

Agar kisi marne wale ka maal sud se haasil hua hai:

  • Waris ko chahiye ke wo maal ki jaayza le — kya ye halal tareeqe se haasil hua tha ya haram (sud)?
  • Halal maal le sakta hai, lekin haram maal kabhi bhi nahi lena chahiye.
  • Agar poori jaidaad haram hai ya shak ho, to usay sadaqa kar de bina sawab ki niyyat ke, jese ki fuqaha ne hukm diya hai.

6. Nateeja

Islam me maal ki paakizaai imaan ka hissa hai. Sud se haasil maal haram hai, chahe zindagi me ho ya maut ke baad. Waris ko chahiye ke wo apne liye sirf halal aur paak maal hi ikhtiyar kare, aur haram maal se daaman bachaaye.

Rizq halal me barkat hai, aur rizq haram me zaleel o ruswai.
